BikeDo Terms of Service

§1. General provisions

  1. These Terms of Service ("Terms") govern the use of the BikeDo mobile application (iOS and Android) and the website bikedo.app (the "Service", "BikeDo").
  2. The service provider is Błażej Kapała, sole proprietor trading as GREEN.MEDIA.PL – Błażej Kapała, tax ID (NIP): 5532346285, statistical number (REGON): 380966136 (the "Provider").

  4. By using the Service, the User accepts these Terms.

§2. Definitions

  • User — a natural person aged at least 13 who uses BikeDo
  • Account — an individual user profile created in the app
  • Content — any material added by the User (photos, bike descriptions, comments, etc.)
  • Free plan — the default plan with feature limits
  • Pro plan — extended plan (currently granted manually by the Provider; paid subscriptions planned in the future)

§3. Technical requirements and age

  1. BikeDo is intended for users who are at least 13 years old. Users under 16 require consent from a legal guardian.
  2. A device running iOS (latest supported versions) or Android (latest supported versions) and Internet access are required.
  3. The website requires a browser supporting HTML5 and JavaScript.

§4. Account registration

  1. Account creation requires an email address and a password, plus acceptance of these Terms and the Privacy Policy.
  2. The User warrants that the data provided at registration is true and current.
  3. One User may have one Account. Creating multiple accounts to circumvent Free plan limits is prohibited.
  4. The Account is personal — the User must not share their Account with third parties.

§5. Scope of services and plan limits

5.1. Free plan (default)

  • Up to 2 bikes
  • Up to 3 photos per bike
  • 5 service records per bike
  • 2 service reminders per bike
  • Basic social features (comments, likes, follows)

5.2. Pro plan

  • Unlimited bikes and photos
  • Full access to service statistics
  • Service history export
  • Custom URLs and embeds
  • Custom handle (nickname)

5.3. Payments

We currently do not charge any fees. Paid Pro subscriptions through Apple App Store / Google Play are planned for the future. Their introduction will be preceded by a Terms update.

§6. User Content

  1. Ownership: The User retains all rights to the Content they add (photos, descriptions, etc.).
  2. License to the Provider: By adding Content, the User grants the Provider a non-exclusive, royalty-free, worldwide license to host, display, copy and modify the Content as needed to provide the Service (e.g. generating thumbnails, distribution via CDN).
  3. Liability: The User is responsible for their Content. They warrant that they have the rights to it or consent from rightsholders.
  4. Public Content: Some Content (e.g. bike profiles marked as public, comments) is visible to other Users and to non-logged-in visitors (e.g. on bikedo.app/bike/{id}).

§7. Prohibited content and behavior

The following is prohibited:

  • Posting content that violates the law, accepted standards, or the rights of others
  • Spam, advertising unrelated to cycling without the Provider's consent
  • Content inciting violence, discrimination, or hate speech
  • Pornographic, offensive, or fraudulent content
  • Use of bots, automated tools, or scraping
  • Attacks on Service infrastructure (DDoS, intrusion attempts, exploits)
  • Impersonating other people or brands
  • Repeatedly creating accounts after a ban

In case of violation, the Provider may block or delete the Account and Content without prior notice.

§8. Push notifications

  1. The app may send push notifications (e.g. about likes, comments, service reminders).
  2. Sending occurs only with the User's system-level consent.
  3. The User can disable notifications at any time in device settings or in the app preferences (per category).

§9. Provider's liability

  1. The Provider takes care to ensure that the Service runs continuously and correctly. However, it does not guarantee uninterrupted operation or absence of errors.
  2. The Provider is not liable for:
    • Content added by Users
    • Consequences of Service interruptions due to circumstances beyond its control (force majeure, infrastructure provider outages)
    • Loss of Content due to User actions (e.g. account deletion)
  3. The Provider's liability is limited to actual damages incurred by the User and documented. It does not cover lost profits.
  4. The above limitations do not exclude the Provider's liability to the extent required by mandatory law (e.g. towards consumers).

§10. Complaints

  1. Complaints regarding the Service can be reported to: [email protected].
  2. A complaint should include: identifying data (email/handle), problem description, expected resolution.
  3. The Provider considers complaints within 14 days of receipt and replies to the email address provided.
  4. If no response is provided within 14 days, the complaint is deemed accepted.

§11. Right of withdrawal (consumers)

  1. Consumers have the right to withdraw from the contract within 14 days of conclusion, without giving reasons.
  2. For BikeDo, the contract is concluded by creating an Account. Withdrawal involves deleting the Account (Settings → Account → Delete account) or sending a notice to [email protected].
  3. The above right does not apply to digital content if performance has begun with the consumer's express consent before the 14 days expire and the consumer has been informed of the loss of the right of withdrawal.

§12. Account deletion

  1. The User may delete their Account at any time in the app (Settings → Account → Delete account) or by request to [email protected].
  2. Account deletion removes all related Content within 30 days (accounting for backups).
  3. Some data may be retained longer if required by law (e.g. accounting records) or for the Provider's legitimate interests (e.g. claims defense).

§13. Changes to the Terms

  1. The Provider may change the Terms for important reasons (legal changes, new features, security).
  2. We will inform you of changes by:
    • in-app notice
    • email to the address provided in the Account
    • updating the "Last updated" date
  3. A User who does not accept the changes may delete their Account. Continued use of the Service after the changes take effect constitutes acceptance.

§14. Governing law and jurisdiction

  1. In matters not regulated by the Terms, Polish law applies.
  2. Disputes arising from use of the Service are settled by the court competent:
    • For Consumers — the court competent for the Consumer's place of residence (per Articles 17, 18 or 19 of the Brussels I bis Regulation for EU residents)
    • For others — the court competent for the Provider's registered office
  3. Consumers may use the EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

§15. Final provisions

  1. The Terms enter into force on the date of publication at bikedo.app/terms.
  2. The current version is always available at bikedo.app/terms.
  3. The Privacy Policy is an integral part of the Terms and is available at bikedo.app/privacy.
  4. If any provision of the Terms is found to be invalid, the remaining provisions remain in force.
